President Donald Trump is taking the fight over voter fraud to the Wisconsin state Supreme Court.
The president’s campaign filed a lawsuit on Tuesday seeking to throw out more than 200,000 ballots in the Badger State, the Washington Examiner reported.
Challenges to votes
Biden was certified the winner in Wisconsin by one of the narrowest margins in all the swing states, with a roughly 20,000-vote lead, according to the Examiner. Trump and his allies have alleged that voter fraud in Democratic cities across the U.S., like Detroit, Philadelphia, and Milwaukee, pushed Biden to an illegitimate victory.
Although Wisconsin completed a recount in Democratic Milwaukee and Dane counties Saturday, the Trump campaign says it’s no good, citing upwards of 221,000 ballots that they argue should be disqualified for various reasons. The lawsuit lays out four categories of votes that they say should be tossed aside.
One category, according to the Examiner, concerns some 28,000 votes from people who the campaign says wrongly self-identified as “indefinitely confined.” Ordinarily, the category refers to elderly or disabled voters who request an absentee ballot without a photo ID, as the Milwaukee Journal Sentinel explains, but the counties issued “guidance” in March allowing anyone to fall under the policy because of the coronavirus, and the state Supreme Court decided the change was illegal.
A second group includes 5,500 “cured” absentee ballots that had missing information, such as the addresses of witnesses, on envelopes that poll workers filled in. The Trump campaign says these corrections are against state law, which requires either voters or a witness to make them.
According to the Washington Examiner, the Trump campaign is also challenging some 17,000 absentee ballots collected by poll workers at “Democracy in the Park” events in Madison, which the campaign says was equivalent to early voting outside the legal window, as well as another 170,000 early, in-person absentee ballots that the campaign said were submitted without applications.
Dems slam lawsuit
Wisconsin’s Democratic governor, Tony Evers, has slammed the challenge as an “outrageous assault on our democracy.”
“President Trump’s [lawsuit] seeks nothing less than to overturn the will of nearly 3.3 million Wisconsin voters,” attorneys for the governor said, according to the Associated Press. “It is a shocking and outrageous assault on our democracy… He is simply trying to seize Wisconsin’s electoral votes, even though he lost the statewide election.”
Trump and his allies have made a number of legal challenges seeking to dismiss hundreds of thousands of ballots, in some cases demanding that state legislatures appoint electors for Trump.
Lawyer Jim Troupis, who filed the Wisconsin suit, told the Washington Examiner that he is confident that despite Evers’ complaints, the challenge will not be dismissed.
“I’m certainly confident it’s not going to be thrown out,” Troupis said. “This action addresses explicit legal violations.”
