Conservative media personality Mark Levin told his audience on Fox News’ Life, Liberty & Levin that the state of Pennsylvania has “abandoned its constitution” in regards to the presidential election, Breitbart reported.
Because of that fact, Levin said a looming “constitutional crisis” means it is time for the nation’s highest court to get involved.
“What we see here is fraud perpetrated against the people of Pennsylvania, against the American people and the Electoral College process by politicians who violated the constitution repeatedly, who have violated the rule of law by a rogue state supreme court,” Levin said Sunday.
“And unless the U.S. Supreme Court — as it did in Bush versus Gore — exercises legitimately its power of judicial review,” he insisted, “We have a potential constitutional crisis in this matter.”
Alito issues order in PA case
Levin said the time for the Supreme Court to act is now.
“[I]n one way or another, Congress will have to resolve it on January 6. But the U.S. Supreme Court shouldn’t just sit there and take a pass when in fact it is time for the U.S. Supreme Court to intercede, which is exactly what the petitioners are asking it to do,” he said.
On Monday, Supreme Court Justice Samuel Alito instructed Pennsylvania state officials to answer a lawsuit filed by Republican Congressman Mike Kelly a day earlier than previously required, Fox News reported.
Kelly argued that Pennsylvania’s decision to allow for no-excuse mail-in voting was unconstitutional, and therefore those ballots should be discarded.
Rejects appeal
Under Alito’s order, the state’s response would need to come by 9 a.m. on Dec. 8, the same day that “safe harbor” status takes effect.
As NPR explained, “Electoral College electors are scheduled to meet in states across the country on the first Monday after the second Wednesday in December (Dec. 14 this year) to cast their votes.”
“And if a state has finalized its results six days before then, according to the [Electoral Count Act], then those results qualify for ‘safe harbor’ status — meaning Congress must treat them as the ‘conclusive’ results, even if, for example, a state’s legislature sends in a competing set of results,” the article states.
On Tuesday, the Supreme Court ultimately decided to reject the Republicans’ appeal to block the certification of the state’s election results. “The application for injunctive relief presented to Justice Alito and by him referred to the Court is denied,” the order said.
