Several reports are indicating that President Joe Biden’s Department of Justice (DOJ) is currently determining whether or not it can bring any federal charges against Kyle Rittenhouse.
This is despite the fact that Rittenhouse was just found “not guilty” of all of the charges that he faced for shooting three individuals, killing two and injuring another, during a Black Lives Matter riot in Kenosha, Wisconsin, last August.
Rittenhouse, during the trial, argued that the shootings were in self-defense, a claim that was supported by the evidence, including by the testimony of the man whom Rittenhouse shot and injured, who admitted that he pointed his gun at Rittenhouse before Rittenhouse shot him.
The aftermath
The political left was incensed after Rittenhouse’s acquittal. In their point of view, Rittenhouse is, at least, a vigilante, if not a White Supremacist vigilante. And, Rittenhouse’s acquittal is merely the latest proof of systemic racism in America’s criminal justice system.
Some Democrats used Rittenhouse’s acquittal to push for criminal justice reforms. Other Democrats, including House Rep. Jerry Nadler (D-NY), called for a DOJ investigation into whether it can bring any federal charges against Rittenhouse.
“This heartbreaking verdict is a miscarriage of justice and sets a dangerous precedent which justifies federal review by DOJ,” Nadler tweeted. “Justice cannot tolerate armed persons crossing state lines looking for trouble while people engage in First Amendment-protected protest.”
President Joe Biden, in his statement, didn’t go so far.
Biden clearly expressed his dissatisfaction with the outcome of the case. But, he also clearly said: “I stand by what the jury has concluded. The jury system works and we have to abide by it.”
Now, though, it appears that Biden’s DOJ is taking up Nadler’s call, investigating whether it can bring federal charges against Rittenhouse.
Will it happen?
Fox News explains why the bringing of federal charges against Rittenhouse by the DOJ would be unlikely.
The outlet reports the Shouse Law Group as explaining that in order for murder to become a federal crime either a violation of federal law is required or the murder must have occurred on federal land or territory. The Shouse Law Group goes on to explain that what Rittenhouse did would not fit into any of the “seven scenarios” of the federal crime of murder.
Still, with the current administration, we wouldn’t be surprised if federal charges are brought against Rittenhouse.
