‘Clearly unconstitutional’: Arizona AG puts up fight against Biden vaccine mandate

President Joe Biden sparked controversy in September when he announced a series of sweeping new federal COVID-19 vaccination requirements that opponents argued were unconstitutional. 

One such opponent is Arizona Attorney General Mark Brnovich, a Republican who recently spoke with Fox News about his effort to fight Biden’s mandate in court. 

“This is one of several lawsuits going on,” Brnovich told host John Roberts during a Wednesday appearance on Fox’s America Reports.

“Our lawsuit is the first one and ours focuses on the Biden administration attempting to have federal employees and federal contractors mandate that their employees get the vaccine,” the AG added. 

“No authority”

Brnovich went on to insist that the vaccine requirements are “clearly unconstitutional,” as “[t]he president has no authority anywhere in the Constitution.”

“It sets a very, very dangerous precedent because at the end of the day our U.S. Constitution can’t be masked, can’t be distanced and it should never be canceled,” he insisted, according to Fox.

“And that’s what the Biden administration is essentially trying to do. They’re using this COVID crisis in order to take unprecedented power that the federal government doesn’t have,” Brnovich concluded. 

According to a separate report from Fox, the federal mandates require that all federal employees, along with those employed by federal contractors, get vaccinated for the coronavirus.

What’s more, another rule put forward by the Occupational Safety and Health Administration (OSHA) stipulates that businesses with over 100 employees must see that their workforce is fully vaccinated as well. 

Business owners secure federal injunction

Fox News also reported that elected officials aren’t the only ones taking a stand; a group of business owners succeeded last week in getting a federal court to issue an injunction to block enforcement of the new rules. 

Fox noted that this has not prevented the Biden administration to continue pushing for vaccine compliance, with White House deputy press secretary Karine Jean-Pierre urging people not to wait.

“Do not wait to take actions that will keep your workplace safe,” Jean-Pierre said. “It is important and critical to do, and waiting to get more people vaccinated will lead to more outbreaks and sickness.”
