Emotions ran high as the judge in the Kyle Rittenhouse shooting case twice dismissed the jury to argue with the prosecution regarding it allegedly inappropriate conduct in the courtroom.
Kenosha County Assistant District Attorney Thomas Binger drew ire from Judge Bruce Schroeder after the lawyer attacked Rittenhouse for just then sharing his testimony after a shooting that had taken place a year ago.
The judge dismissed the jury before focusing his response on the prosecution.
The First Violation
After dismissing the jury, Schroeder told Binger it was a serious “constitutional violation” to attack Rittenhouse’s right to remain silent.
“You’re right on the borderline. You may be over. But it better stop,” Schroeder warned the prosecutor.
“This is a grave constitutional violation for you to talk about the defendant’s silence,” Schroeder said.

The Second Violation
On a second occasion, the prosecution brought up an issue excluded in a pretrial order regarding a video of Rittenhouse’s response to shoplifters at a CVS.
After the jury left the room the second time, defense attorney Mark Richards warned the next time such a violation happened, he would request a mistrial.
The judge unleashed on Binger for the action.

“Why would you think that that made it OK for you to bring this matter before the jury?” Schroeder he told Binger. “You should have come and asked for reconsideration!”
After more heated discussion, the judge shot back, “Don’t get brazen with me!”
The trial has capture the attention of the nation, but the evidence appears to show Rittenhouse protecting himself rather than launching an attack on innocent bystanders as the trial continues.
