White House Press Secretary Jen Psaki said Thursday the White House is encouraging businesses to move forward on implementing COVID-19 vaccine mandates in their workplaces even though courts have issued two stays on President Joe Biden’s mandate, The Daily Wire reports.
“Let me be very clear: Our message to businesses right now is to move forward with measures that will make their workplaces safer and protect them and their workforces from COVID-19,” Psaki told reporters. “That was our message after the first stay issued by the Fifth Circuit, that remains our message, and nothing has changed.”
Psaki claimed that 60% of businesses are going forward with the mandate voluntarily, despite the injunction giving them a way out until an appeal can be heard.
The Daily Wire’s CEO Jeremy Boreing celebrated the ruling and said his company had not planned to comply with the mandate even if it were enforced, and he urged other businesses to follow suit.
“OSHA mandate is off”
“Until the Sixth Circuit or Supreme Court rules otherwise, the OSHA mandate is off. No vaccine requirement. No testing requirement. No masks. No fines. Nothing. You don’t have to do anything,” Boreing said.
“If you’re a business that believes in freedom, the best way you can help is just to stop. Stop implementing OSHA’s illegal mandate because as of today, you don’t have to. Don’t make it easy for them by making your employees choose between their jobs and their freedom,” Boreing concluded.
In fact, OSHA moved on Thursday to suspend the enforcement of the mandate pending the outcome of the lawsuit or a favorable court ruling.
The 5th Circuit called the mandate “fatally flawed” and according to The Hill, ordered OSHA not to enforce the requirement “pending adequate judicial review” of the mandate.

Some businesses were thought to be using Biden’s mandate as an excuse to force the vaccination issue, and would want to move forward with mandates even in the absence of enforceable OSHA rules.
The deadline was supposed to be Jan. 4 for employees to be fully vaccinated, and though Psaki claimed that the White House was sticking to its original timeline, the lack of enforcement will not be easy to overcome.
Those business owners and employees opposed to vaccine mandates are on a firm legal footing to resist the mandate at this time.
Employers have been worried that labor shortages will worsen if they’re forced to fire workers for not getting vaccinated.
