Legal expert says Rittenhouse may have defamation cases against Pres. Biden and the mainstream media

The criminal trial of Kyle Rittenhouse may now be over, with the teen being found not guilty of all charges. But, this may not be the last we hear of Rittenhouse.

Many are now encouraging Rittenhouse to file defamation lawsuits against various entities, and one legal expert believes that Rittenhouse could have a good defamation case against both President Joe Biden and the mainstream media. 

The lawyer who is making this claim is Todd McMurtry, the man who represented former Covington Catholic High School student Nicholas Sandmann in his defamation lawsuit against CNN.

McMurtry, with regard to Biden, is targeting a social media post that Biden made on September 30th, 2020, before he became president.

“It’s actionable”

Biden’s tweet includes both a caption and a video. The caption reads: “There’s no other way to put it: the President of the United States refused to disavow white supremacists on the debate stage last night.”

The video, according to Fox News, shows White nationalists marching in Charlottesville, Virginia, and similar images. And, while the footage is being played, the Fox News Channel’s Chris Wallace can be heard in the background asking Trump, during that infamous presidential debate with Biden, whether he is willing to condemn White supremacy.

But, here’s the key: during one part of the video, there is a photo of Kyle Rittenhouse holding a rifle on the same night that Rittenhouse, in self-defense, shot and killed two individuals and shot and injured another during a left-wing riot in Kenosha, Wisconsin.

McMurtry believes that this social media post could be trouble for Biden.

“What you take from that tweet is that Kyle Rittenhouse was using his rifle and engaging in White supremacist misconduct so it’s actionable,” McMurtry said. “Not necessarily going to win, but it’s actionable.”

There’s more

McMurtry also argued that Rittenhouse may have a defamation case against those mainstream media outlets that have gone so far as to call Rittenhouse a “murderer,” among other things.

“I think Rittenhouse may be able to do the same thing when commentators on MSNBC say he’s a school shooter, a White supremacist, even a vigilante,” McMurtry said. “Lots of media people said he was a murderer, and I think that’s actionable because that suggests that he committed a crime, and we now know that he didn’t. When you just throw this stuff out there, you take risks.”

We’ll see if Rittenhouse and his lawyers decide to pursue any of these avenues. But, for now, the teen is probably just relieved that justice has prevailed.
