Kyle Rittenhouse judge drops gun charge

Judge Bruce Schroeder dropped a weapons charge against Kyle Rittenhouse on Monday as the high-profile shooting case continues in Kenosha, Wisconsin.

“If the barrel length is less than 16 inches, or an overall less than 26 inches, then I’ll deny the [defense] motion; if it does not meet those specifications, then the defense motion will be granted,” the judge said.

Other Charges

Another charge related to a curfew violation was dropped last week.

The dropped charge leaves the remaining charges of murder of two men and attempted murder of a third man. Rittenhouse maintains the shootings were in self-defense.

If the jury rules Rittenhouse acted in self-defense, he would then be free from all charges. Closing arguments began Monday, though it is uncertain how long it will take to complete the case and for the jury to determine a verdict.

Mistrial Option

The option of a mistrial has also been considered. The mistrial discussion arose after the prosecution used an attack on Rittenhouse’s Fifth Amendment regarding content determined should be excluded during the pretrial.

In addition, a report of the jurors being recorded on the way to a bus also led to speculation the trial could end in a mistrial due to jury interference.

The case’s decision will likely lead to controversy whatever the outcome. Some activists have already argued for a violent response if Rittenhouse is set free.
