Dems will fail in civil rights lawsuit against Rittenhouse, top law professor claims

In the wake of the not guilty verdict in the Kyle Rittenhouse trial earlier this month, Democrats and their media allies wailed, and immediately called for action to be taken against the innocent Illinois teenager.

At least one powerful House Democrat, Rep. Jerry Nadler (NY), went as far as calling for a Justice Department investigation and possible DOJ-led civil suit against the teen, but according to the Washington Examiner, Cornell Law School professor William Jacobson asserted that any such legal action against Rittenhouse is guaranteed to “fail.”

House Judiciary Committee Chairman Nadler had labeled the outcome of Rittenhouse’s fate as a “miscarriage of justice,” which he claimed deserved immediate “federal review.”

As far as Jacobson is concerned, Rittenhouse’s “overwhelming” self-defense claim will be more than sturdy enough to thwart any civil — or revenge — lawsuits.

“A civil case will fail”

Jacobson, who also runs Legal Insurrection, told the Examiner that Rittenhouse doesn’t have much to be worried about on the civil suit front.

“There is no obvious basis for a civil rights prosecution against Rittenhouse,” the professor said.

He added: “The videos are the videos, and the testimony already is under oath from witnesses and alleged victim Gaige Grosskreutz. A civil case will fail even by a preponderance of the evidence.”

Jacobson isn’t the only high-profile law expert who believes that Rittenhouse is in the clear, legally speaking, as constitutional law professor Jonathan Turley echoed that sentiment in a recent Fox News piece.

They can’t ignore the law

“Rittenhouse was acquitted on state charges by a state jury. Moreover, while some have called for reducing self-defense protections, the jury applied the law as it currently appears on the books,” Turley wrote.

He added: “It is not allowed to simply ignore the law to seek our own criminal justice rules.”

Turley went on to point out that President Joe Biden’s Justice Department lacks a specific office that goes after “miscarriages of justice,” and added that if the DOJ would pursue such a ridiculous action, it would set a dangerous precedent, as it would obviously be a case of questioning a jury’s just verdict because of personal disagreements with the verdict.

The only civil suits that will likely be seen in the wake of the trial will be the numerous defamation lawsuits that will hopefully be filed by Rittenhouse’s attorneys against a long list of media outlets and Democratic politicians.
