President Joe Biden took some time away from doing damage control on the Afghanistan disaster to weigh in on the culture wars after the Supreme Court upheld an almost total ban on abortion in Texas that has been called a virtual repeal of Roe v. Wade.
Biden threatened to use every weapon in his political arsenal to uphold the so-called right to an abortion after the “unconstitutional” decision, Axios reported Thursday.
Biden responds to Texas ban
In a 5–4 decision this week, the Supreme Court turned down an emergency petition from pro-abortion groups seeking to block the Texas law, which bans abortions after six weeks into pregnancy. In an unusual twist, the legislation allows private citizens to file lawsuits against those who “aid and abet” an abortion after that point, Reuters notes.
The SCOTUS did not weigh the constitutionality of the law, but by allowing it to go into effect, Texas has become the first state in five decades to essentially ban abortion.
While Texans might have thought that they had the right to make their own laws, apparently that’s not allowed, according to Biden.
In a searing statement, he vowed to bring a “whole of government” response to shore up the imaginary “right” to an abortion that he insists exists somewhere in the penumbra of the Constitution.
“The Supreme Court’s ruling overnight is an unprecedented assault on a woman’s constitutional rights under Roe v. Wade, which has been the law of the land for almost fifty years,” he said, according to Axios.
Dems left frothing over abortion restrictions
Despite what Biden says, there is no metaphysical law saying that a single Supreme Court precedent from the 1970s is binding until the end of time.
But Democratic party ghouls like Sen. Elizabeth Warren (MA) wailed that Texas had outlawed “safe, legal” abortion — notice the omission of “rare” — or what she called “basic health care.”
The Supreme Court’s three liberals outed themselves as political activists and joined in the sentimental parade, with Justice Sonia Sotomayor accusing her colleagues of “burying their heads in the sand” by refusing to bind themselves to faulty legal and moral reasoning from generations ago, as Axios reported.
Chief Justice John Roberts (of course) joined them and criticized the “unprecedented” law, which he said gave the state a way to avoid responsibility by placing the burden of enforcement on private citizens. Roberts evidently pleased Biden, who cited him.
“While the Chief Justice was clear to stress that the action by the Supreme Court is not a final ruling on the future of Roe, the impact of last night’s decision will be immediate and requires an immediate response,” Biden said, according to Axios.
