Biden refuses to release list of Supreme Court picks

Democrat presidential candidate Joe Biden said on Sunday that he will not release a list of potential Supreme Court nominees before the election like President Donald Trump did.

“We can’t ignore the cherished system of checks and balances. That includes this whole business of releasing a list of potential nominees that I would put forward,” Biden explained during a speech in Philadelphia, Pennsylvania.

Biden accused the Trump campaign of waiting until after Justice Ruth Bader Ginsburg died to criticize him for not releasing a list of nominees.

“It’s no wonder they ask that I release the list only after she passed away. It is a game for them. It is a play to gin up emotions and anger. There’s a reason why no other candidate than President Trump has ever done such a thing,” Biden said during the speech.

The only trouble is, Trump criticized Biden for not releasing his own list well before Ginsburg’s passing. Almost two weeks ago, Trump said at a rally that Biden wouldn’t release a list because “they are so far left [they] could never withstand scrutiny.”

Biden won’t name potential nominees

Biden gave three reasons during the speech for his refusal to release a list.

“First, putting a judge’s name on a list like that could influence that person’s decision making as a judge, and that would be wrong — or at least create the perception it would influence,” Biden said.

Second, he said anyone he did name would be targeted with “unrelenting personal attacks” between now and 2021 when he would be inaugurated if elected.

“Thirdly and finally, perhaps most importantly, if I win, I’ll make my choice for the Supreme Court not based on a partisan election campaign, but on what prior presidents have done,” he said, adding that he would seek the “advice” and “consent” of both Republicans and Democrats in the Senate as part of his decision-making process.

Biden would nominate black woman

Biden did say months ago during the primaries that he would nominate an African-American woman to the high court if he got the chance to make a nomination, Fox News noted.

While it would be great to see a woman of color on the court, the intersectional nature of Democrats’ choices seems to be hurting them in some cases.

Biden did not get a poll bump from choosing Sen. Kamala Harris as his running mate, and he took weeks to finally decide to choose her after being determined to choose a woman of color because of identity politics.
