In recent years, many on the left have grown increasingly hostile towards the Supreme Court, with some suggesting that it needs to be expanded.
The hostility appears to be growing more intense, with one high-profile Democrat, Sen. Elizabeth Warren (MA), going so far as to label the Supreme Court as “extremist.”
Warren made the allegation during an interview Sunday with MSNBC host Jonathan Capehart.
According to Mediaite, Warren and Capehart were both upset that the Supreme Court has yet to strike down a Texas law that bans abortion once a baby’s heartbeat can be detected, usually around the six-week mark of a pregnancy.
“Out of step”
“Look,” Warren told Capehart, “the Court has signaled 40 different ways that it is an extremist court, out of step with the American people, and that it’s willing to line up and take a shot at Roe v. Wade.”
“Now whether they’ll get rid of it entirely or just let the states continue to chip at it — come on,” Warren continued. “They’ve given us every possible signal. But for me, what that means is it’s time for Congress to step up.”
The pro-abortion Massachusetts Democrat went on to call for federal legislation to override state-level abortion restrictions, telling Capehart, “We don’t need the Supreme Court to do that, the United States Congress could do that.”
She added: “When 70% of the people support something, by golly, I think we ought to get out there and get that done.”
Calls for court-packing
The senator’s remarks came after Capehart played a clip of Texas state Rep. Jasmine Crockett (D) complaining about the Supreme Court, “acting like [abortion] is an issue that we need to vacillate over.”
Crockett went on to point out that Roe v. Wade was decided in the decade before she was born, insisting that the Supreme Court’s willingness to revisit abortion is “a problem.”
Some Democrats have been open about their desire to offset the conservative appointments that former President Donald Trump made by increasing the number of justices on the high court — commonly referred to as court-packing — which would prevent conservative opinions from dominating potential landmark cases.
Earlier this year, New York Rep. Jerrold Nadler (D), and Massachusetts Sen. Ed Markey (D) unveiled legislation to make that happen, as Fox News previously reported. However, getting any such bill passed would prove to be extremely difficult given that West Virginia Sen. Joe Manchin (D) has made his opposition to court-packing crystal clear this year.
