A top Biden administration adviser appears to have acknowledged the truth about a recently announced nationwide vaccine mandate for businesses with more than 100 employees.
After President Joe Biden announced the new COVID-19 regulation, critics began to argue that it was unconstitutional. And according to Fox News, White House Chief of Staff Ron Klain appeared to imply as much when he shared a tweet from MSNBC host Stephanie Ruhle.
“Knows it’s likely illegal”
The initial tweet opined that enforcing the vaccine mandate through the Occupational Safety and Health Administration “as an emergency workplace safety rule is the ultimate work-around for the Federal [government] to require vaccinations.”
Klain quickly retweeted Ruhle’s sentiment in an apparent show of support. Sen. Ted Cruz (R-TX) chimed in with his take on the matter.

The senator asserted that the Biden administration “knows it’s likely illegal,” going on to reference a federal eviction moratorium that Biden himself acknowledged might be struck down on constitutional grounds.
Nevertheless, the president moved to reimpose an expired moratorium in August without congressional approval even after the U.S. Supreme Court blocked an earlier attempted extension.
“Hammering down on private businesses”
Prior to announcing his latest sweeping COVID-19 mandate, Biden’s approval rating had been trending downward as more Americans react negatively to his administration’s policy on the pandemic and various other issues.
His mandate will require employees at private companies with more than 100 workers to either receive the COVID-19 vaccine or weekly tests for the virus. Noncompliant businesses could be hit with steep fines.
A number of GOP governors indicated that they would not comply with the mandate and would launch legal action against it.
Arizona Gov. Doug Ducey (R) echoed that position in his statement, asserting: “This is exactly the kind of big government overreach we have tried so hard to prevent in Arizona — now the Biden-Harris administration is hammering down on private businesses and individual freedoms in an unprecedented and dangerous way. This will never stand up in court.”
As the Daily Wire noted, several companies impacted by the order have already indicated that they intend to seek legal relief from the order and do not intend to enforce it.
