SCOTUS rules against President Biden’s eviction moratorium

The Supreme Court just put a stop to President Joe Biden’s attempt to extend the moratorium on evictions, Breitbart reports. 

And, on top of that, the Democrats don’t appear to be getting ready to pursue a legislative extension of the eviction moratorium, which suggests that the eviction moratorium is now history.

The latest ruling

The reader may remember that, following the July 31st expiration of the original eviction moratorium, the Biden administration, at the behest of some of its far-left cohorts, decided to implement a new eviction moratorium by way of the Centers for Disease Control and Prevention (CDC).

In the process, the Biden administration made one change to the original eviction moratorium, it limited it to those areas of the country “experiencing substantial and high levels of community transmission.” This change was a pretty feeble attempt at making it appear as though the CDC actually had the authority to issue such a moratorium.

Property owners subsequently challenged the new moratorium in court arguing just this, that the CDC lacked the authority to implement this moratorium. On Thursday, the court agreed, granting the property owners a stay on the grounds that they were “virtually certain” to win.

“Careful review of that record makes clear that the applicants are virtually certain to succeed on the merits of their argument that the CDC has exceeded its authority,” the court wrote. “It would be one thing if Congress had specifically authorized the action that the CDC has taken. But that has not happened.”

The court, instead, said that the CDC relied on an old, irrelevant law, and that “the equities do not justify” ruling against the property owners.

It was a 6 to 3 decision with the court’s liberal justices – Stephen Breyer, Sonia Sotomayor, and Elena Kagan – dissenting.

The aftermath

Following this decision, one would expect Democratic leadership to pivot to pursuing the eviction moratorium through legislation. While some Democrats are calling for such an approach, Democratic leadership doesn’t seem to be answering that call.

Instead, House Speaker Nancy Pelosi (D-CA) has released a statement condemning the Supreme Court for its decision.

“Last night, the Supreme Court immorally ripped away that relief in a ruling that is arbitrary and cruel,” she wrote. She concluded by stating that “Congressional Democrats have not and will not ever accept a situation of mass evictions.”But, Pelosi stopped short of saying that a legislative solution is forthcoming.

We’ll have to see if the Democrats come up with anything. But, for now, it appears that the eviction moratorium is over.
