Derek Chauvin’s attorney files a motion for a new trial

Legal experts suggested that the Derek Chauvin case likely did not end with Chauvin’s guilty verdict. And, it hasn’t.

Breitbart reports that Eric Nelson, Derek Chauvin’s attorney, just asked the court for a new trial.

On Tuesday, Nelson filed a motion for a new trial with the Hennepin County District Court in Minnesota. In the motion, Nelson argued that the court and the presiding judge, Peter A. Cahill, made a number of mistakes during Chauvin’s trial.

One mistake, according to Nelson, was not allowing the trial to be moved out of Hennepin County. Nelson, during the trial, had asked for the venue relocation given the strong local emotions about the case.

Another mistake, according to Nelson, was not granting a mistrial. Nelson had asked for a mistrial after the judge failed to sequester the jury and after several prominent Democrats suggested that there would be further unrest if the jury did not find Chauvin guilty.

Nelson, in the motion, also alleged prosecutorial misconduct, “including but not limited to: disparaging the Defense; improper vouching; and failing to adequately prepare its witnesses.”

“The cumulative effect of the multiple errors in these proceedings deprived Mr. Chauvin of a fair trial, in violation of his constitutional rights,” Nelson wrote. Accordingly, he asked the court to impeach the guilty verdict.

The other side

The prosecution has put out a statement in response to Nelson’s motion.

“The court has already rejected many of these arguments and the State will vigorously oppose them,” said John Stiles, deputy chief of staff for Minnesota Attorney General Keith Ellison.

Chauvin currently is scheduled to be sentenced in June.

It ought to be noted that Nelson’s motion did not include in the motion any mention of the most recent news about juror Brandon Mitchell.

The Washington Times reports, “Chauvin juror Brandon Mitchell has said he doesn’t remember wearing or even owning a George Floyd-themed T-shirt, but it turns out he sported it more than once. He wore the shirt, which says ‘Get Your Knee Off Our Necks/BLM,’ during an Oct. 19 episode of ‘The Wholesome Podcast,’ a dating-and-relationships show that he co-hosts, as shown on YouTube and flagged Wednesday on social media.”
