President Joe Biden campaigned for office, in part, on a promise to extend amnesty to at least 11 million illegal immigrants residing in the U.S., and though it seems unlikely that he will fulfill that vow through legislation, he may be able to achieve some measure of amnesty for a portion of illegal immigrants by other means.
In fact, Biden reportedly just accomplished a “de facto amnesty” plan for a particular class of illegal immigrants by way of a rule reversal that will allow immigrants with removal orders to obtain work permits and remain in the U.S. indefinitely, Breitbart reported.
Rule reversal filed
Near the end of his term in office, former President Donald Trump’s administration proposed a rule that would have prohibited illegal migrants with final deportation orders from being granted a permit to continue working legally.
Unfortunately, that proposed rule had yet to take effect, and now Biden’s administration has withdrawn and reversed that rule with a filing to the Federal Register on May 7 by Homeland Security Secretary Alejandro Mayorkas.
The filing essentially withdrew the proposed rule that was first published in November 2020 that, if implemented, would have revoked the authorization for work permits for “individuals who have a final order of removal and are released from DHS custody on an order of supervision.”
As was briefly noted in the filing, and explained more broadly by Breitbart, those individuals tend more often than not to be illegal migrants with criminal records who have been ordered deported but have yet to leave the United States because, due to their criminal records, their home countries refuse to allow them to return.
Competing for jobs
Among the reasons cited by the administration for the reversal were the “exorbitant costs and burdens on U.S. employers related to labor turnover” as well as anticipated “tax revenues” at the state and federal levels.
In other words, at a time when an estimated 9.8 million Americans are unemployed and searching for a job, according to the Bureau of Labor Statistics, the Biden administration intends to give work permits to illegal migrants who’ve been ordered deported so that they can compete with those out-of-work Americans for what jobs are available.
Easier than amnesty legislation
The proposed rule reversal was utterly condemned in a statement to Breitbart from Jessica Vaughn of the Center for Immigration Studies, suggesting that it amounted to “de facto amnesty” for an untold number of illegal immigrants.
“This is yet another common sense Trump reform that is being reversed,” Vaughan told Breitbart. “Most Americans would be astounded to hear that in 2019 the government issued more than 25,000 work permits to people who have been ordered removed by an immigration judge.”
“These are often criminals who can’t be deported because their home country refuses to take them back,” she continued. “So we just let them stay, with benefits like a work permit. The Trump administration finally got around to stopping this practice, but not fast enough to keep it from being undone.”
“We can expect the Biden administration to use the work permit authority to the maximum extent possible, because it’s a de facto amnesty that is easier than trying to get an amnesty bill through Congress,” Vaughn added.
