Hunter Biden could face fines, jail time for allegedly lying on ATF background check form

Text messages and records held at the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) seem to show that Hunter Biden possibly lied on an application to purchase a firearm at a gun store in 2018 — a felony that carries up to a $250,000 fine and up to 10 years in prison, according to Breitbart

A text message concerning the loss of Biden’s gun led to an investigation by Delaware state troopers and the Federal Bureau of Investigation (FBI), which indicated that he purchased the gun 11 days before his then-lover Hallie Biden allegedly threw it into a trash can outside of a gourmet grocery store in October 2018.

The ATF background check form required to buy a gun asks the question, “Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.”

Hunter Biden was discharged from the U.S. Navy Reserve in 2013 for cocaine usage. Additionally, police found a crack pipe in his abandoned rental car after an accident in 2017, so it is unclear whether he would be able to answer that question with a “no” at the time of his firearm purchase.

Multiple investigations

In addition to the 2018 investigation over the loss of the gun, which was recovered a few days later when a dumpster diver turned it in to local authorities, Hunter Biden is also being investigated over possible tax fraud involving income from foreign sources.

Some of the evidence for those investigations, including the gun and ATF application, has originated from emails and text messages found on a hard drive left at a Delaware computer store, which sparked a massive scandal in the lead-up to the 2020 election.

The gun store owner seemingly verified that Hunter Biden purchased a firearm in 2018, given the fact that he said he turned Biden’s paperwork into the ATF for processing, as would have been standard procedure.

Hallie Biden reportedly took the gun away at some point because she was worried he would hurt himself and suggested that his use of drugs and alcohol was still ongoing, according to information gleaned from stored text messages.

“When the police the FBI the secret service came on the scene she said she took it from me because she was scared I would harm myself due to my drug and alcohol problem and our volatile relationship and that she was afraid for the kids,” Hunter Biden reportedly told his sister-in-law, Liz Secundy, in a text message.

Prosecution unlikely

While the penalty for falsifying information on an ATF background form is stiff, the U.S. government rarely enforces the potential penalties.

Out of 112,090 violations, only 12,710 were investigated and of those, only 12, or 0.1%, were prosecuted.

While Biden could be slapped with a stiff fine and spend a decade in jail over the falsification of information on a federal background check form, it is unlikely that he’ll suffer any consequences, whatsoever.
