The U.S. Supreme Court is allowing the Democrats’ to continue in their pursuit of former President Donald Trump’s tax returns.
Breitbart reports that the U.S. Supreme Court has issued a decision that will allow a subpoena for Trump’s tax returns to continue.
Background
Throughout his presidency, different groups of Democrats tried to obtain Trump’s tax return on the assumption that they will find some wrongdoing contained therein.
This particular Supreme Court ruling has to do with the investigation that is being led by prosecutors in New York City. Headed by Manhattan District Attorney Cy Vance Jr., this investigation is said to be into whether Trump’s organization has committed insurance fraud or bank fraud.
As part of this investigation, Vance and his team have subpoenaed Trump’s tax returns. They are specifically looking to get their hands on about eight years of these documents and other financial records.
Trump and his legal team have been trying to fend off the subpoena in court. Their first try in a federal court failed back in August of 2020, and they failed again in October 2020 at the federal appellate court level.
This left the Supreme Court as Trump and his team’s last resort.
The latest
What Trump’s lawyers were asking the Supreme Court was for the justices to issue a stay for the subpoena. But, this week, the justices turned that request down.
“The Supreme Court has cleared the way for prosecutors in New York City to receive eight years of former President Donald Trump’s tax returns and other financial records as part of an ongoing investigation into possible tax, insurance, and bank fraud in Trump’s business empire,” Politico reports.
The Supreme Court justices, according to the outlet, did not explain their decision.
This is the second loss that Trump has experienced in this case at the U.S. Supreme Court level, as the justices in July of 2020 rejected Trump’s argument that he was immune from state and local criminal investigations as the U.S. president. But, this was Trump’s first loss in the case since conservative Justice Amy Coney Barrett joined the court. It appears that all of the justices were in agreement here.
The Supreme Court has thus given Vance the go-ahead to obtain Trump’s tax returns and financial statements. Considering that this is part of a grand jury investigation, the records would not be released publicly unless charges are brought against Trump and the tax returns are introduced as evidence.
